SEE the “OTARD Rule Amendment” – “FCC’s Over-The-Air Reception Devices Rule.” “The rule applies to individuals who place antennas that meet size limitations on property that they own or rent and that is within their exclusive use or control, including condominium owners and cooperative owners, and tenants who have an area where they have exclusive use, such as a balcony or patio, in which to install the antenna. The rule applies to townhomes and manufactured homes, as well as to single family homes. This means your neighbor has the right to place a 5G antenna – aka “small cell” or “microcell” or “box” on their home. Telecom corporations can override your right to protect your health.

Stopping OTARD Depends on You
If you don’t want to wake up in the morning and see a massive base station antenna on your neighbor’s house, you must take action, NOW. These companies are moving fast and so should you. Stopping OTARD in your community depends on YOU.
Because the FCC preempted ALL our rights: You won’t be notified ahead of time. You can’t sue the neighbor or the wireless companies or even enforce HOA and deed restrictions. The only thing you can do is educate your neighbors and community so they will say NO when they receive solicitations. CHD has created a toolkit to get you started.
Ask Your Neighbors to Sign the PLEDGE
To help you get more of your neighbors committed to keeping OTARD antennas away from your community, ask your neighbors to sign a pledge that they will say NO to any solicitation to install a transmitting antenna on or inside their home, or any other place on their property. You can use this sample Pledge form and adjust it to your community or create your own. The more signatures you get the greater the chance other neighbors will sign.
Educate Your Neighbors About the Health Effects
The harms of the radiation emitted from wireless devices and infrastructure are scientifically proven. Thousands of scientific studies have proven the biological and adverse effects of wireless technology. The harms are not merely potential, but existing and vast. Wireless radiation causes conditions like Radiation Sickness (also known as Electro-Sensitivity or Microwave Sickness) and certain cancers, and it also aggravates other conditions such as ADHD and neurodevelopmental conditions, anxiety, seizures and others.
We have prepared this summary so you can read and learn and also share with your neighbors.
Let Us Know If You or Your Neighbor Received a Solicitation
OTARD’s rule amendment preempted the requirement for any applications, permits, or notice. This harms our ability to learn about planned installations and help communities and those affected use the democratic process to effect change.
CHD created a program to track solicitations for the installation of antennas to help warn communities, at least to some degree. Please inform us about solicitations by filling out this form and sharing it with others.
People around the country have been reporting they have been offered money in exchange for installing antennas on their homes or property. Most reported being approached by salespeople who knocked on their doors; others received flyers or emails. Here is an example of a flyer we got a hold of:
“Earn $600 – Get paid for doing nothing while helping your community. Be the first person to provide Internet of Things coverage in your neighborhood.”
Educate Your Neighbors About OTARD
We have created a sample neighborhood letter that you can use to give your neighbors, friends, and family.
OTARD’s rule amendment will create a “Wireless Wild West” by allowing the installation of wireless transmitting antennas on private homes without requiring any notice to neighboring property owners and by removing any ability to object to their installation or recover damages.
OTARD’s sweeping preemptions and the use of homes for deployment will likely lead to the most significant and rapid proliferation of 5G, Internet of Things (IoT) mesh networks and help speed the 1,000,000 on-the-ground deployments of antennas used by SpaceX satellites, both in urban and rural areas.
OTARD harms our health rights, erodes our property rights and the value of our homes, and adversely affects our privacy and security in our homes.
OTARD antennas are especially dangerous because of their proximity to our homes and our children’s bedrooms. Distance is crucial.
OTARD severely undermines the effectiveness of communities’ and municipalities’ efforts to keep 5G at bay, away from homes and communities. Many homeowners’ associations, municipalities, as well as the Conference of Mayors, objected to the rule. The FCC passed the rule anyway.
OTARD adversely affects neighbor relations. The rule amendment gives people the right to violate their neighbors’ rights and health. Rules of nuisance and trespass are preempted. The rule will tear apart communities. The most acute situation for those whose sickness will be aggravated by exposure that will adversely affect.
OTARD rule amendment preempts federal and state civil rights laws that protect the disabled and their rights for accommodation. The FCC is well aware of the sickness and has received hundreds of personal pleas, including sick children’s parents. Instead of taking action to protect them or at least not harm them, the FCC eliminated ALL of their rights. The FCC is adamant about suppressing any discussion about sickness from wireless and simply treats those who are sick as a “barrier” to deployment. Those who have already been injured and suffer from Radiation Sickness, cancer, neurodevelopmental conditions like ADHD, Autism, as well as anxiety and seizures, will not be entitled to accommodation. Families will be constructively evicted and will have nowhere to go to escape this harmful radiation.

The typical size of 4G cell towers range from 50 to 200 feet in height, and are located often in industrial or commercial areas. Their coverage range allows towers to be spaced miles apart as well. 5G, on the other hand, particularly the mid- and high-band cells, incorporates “small cells” that are smaller in size and must be installed closer together to support their high-power but short range. This will create a network of small cell sites with antennas as close as few hundred feet apart, potentially in residential areas.
5G small cells often resemble small utility boxes and attach to poles shorter than that of 4G. Along with the performance benefits of 5G, including higher data rates, lower latency and increased capacity, 5G has the potential to improve connectivity to education and rural internet access. 5G may also improve efficiency for increasingly-digital industries, like green energy production.
